1. Introduction

Welcome to ServiCore ("ServiCore," "Service," "Platform"), a product owned and operated by Intelygic ("Intelygic," "we," "us," or "our"), a company registered in the State of Indiana, USA.

This Privacy Policy explains how we collect, use, disclose, and safeguard information when you, as a "Customer" or an "End-User," use our platform and website ServiCore.io.

2. Our Role: Data Controller vs. Data Processor

Intelygic as Data Controller: We act as the Data Controller for personal information we collect from Customers to register and bill accounts.

Intelygic as Data Processor: We act as the Data Processor for the information that our Customers and End-Users upload, manage, and store within the platform.

3. Information We Collect (As Data Controller)

We collect Customer Account Information, Payment Information (via third-party processors like Stripe), and Security/Operational Data (IP addresses and browser types for security purposes).

4. Information We Process (As Data Processor)

We process End-User Information, Customer’s Client Information, and Timesheet/Expense Data on behalf of our Customers.

5. How We Use Your Information

We use your data to maintain accounts, process payments, and improve our website. We do not sell, rent, or lease your personal information. We do not use your data to train AI models.

6. How We Share and Disclose Information

We use trusted sub-processors for Cloud Hosting (Hostinger), Payment Processing (Stripe/PayPal), and Transactional Email (Mailgun/SendGrid).

7. Third-Party Integrations

Data sharing with QuickBooks or other integrations is controlled entirely by you. We only use retrieved data to fulfill the synchronization features you request.

8. Data Security

We use SSL/TLS encryption for data in transit and encryption at rest. We offer logical data segregation for multi-tenant users and physical isolation for private-tenant users.

9. Data Retention

Service Data is retained while the account is active. Upon cancellation, data is permanently deleted after 30 days unless legal requirements dictate otherwise.

10. International Data Transfers

Information will be processed in the United States. We ensure transfers are lawful through Standard Contractual Clauses (SCCs).

11. Your Data Protection Rights

Depending on your location, you have the right to Access, Rectification, Erasure, and Portability. Contact us at privacy@intelygic.com to exercise these rights.

12. Jurisdiction-Specific Notices

We comply with GDPR (EU) and CCPA (California). We do not "sell" personal information.

We may update this policy periodically. Significant changes will be notified via email or a platform update.

By using the ServiCore.io platform, you agree to be bound by these terms. If you represent a company, you confirm you have the authority to bind that entity to this Agreement.

1. Incorporation of Privacy Policy

Your use of the Service is governed by our Privacy Policy, which is incorporated by reference.

2. The Service

Intelygic provides ServiCore as a SaaS solution for time management, expense tracking, and invoicing. We reserve the right to modify or update the Service at any time.

3. License Grant

We grant you a limited, non-transferable, revocable license to use the Service for internal business purposes.

4. Customer Accounts & Responsibilities

You are responsible for the confidentiality of your account credentials and for all activities that occur under your account.

5. Acceptable Use and Restrictions

You may not reverse engineer the service, build a competitive product, or use the service for transmitting malicious code or infringing material.

6. Customer Data

You retain all ownership of your Customer Data. You grant us a limited license to store and transmit this data solely to provide the Service.

7. Fees and Payment

Subscription fees are billed in advance and are non-refundable. Non-payment may result in immediate suspension of access.

8. Third-Party Integrations

Integrations (e.g., QuickBooks) are provided "AS IS." We are not responsible for the data handling practices of third-party services.

9. Confidentiality

Both parties agree to protect non-public information with reasonable care.

10. Term and Termination

This agreement continues as long as you have an active subscription. Either party may terminate for material breach with 30 days' notice.

11. Warranty Disclaimer

The Service is provided "AS IS" without warranties of any kind.

12. Limitation of Liability

Intelygic is not liable for indirect or consequential damages. Aggregate liability is limited to the fees paid in the last 12 months.

13. Indemnification

You agree to defend Intelygic against claims arising from your breach of this agreement or your data content.

14. Governing Law

This agreement is governed by the laws of the State of Indiana, USA.

15. General

These terms constitute the entire agreement. If any part is unenforceable, the rest remains in effect.
